When the constitutional amendment was presented to the states for ratification on February 1, 1865, there were 36 states in the United States, including those that had been in rebellion; the amendment needed to be ratified by at least 27 states for it to take effect. The amendment had been adopted by 18 states by the end of February. The ex-Confederate states of Virginia and Louisiana were among them, and ratifications were obtained in both of them. Reconstruction governments submitted their proposals. These, as well as subsequent ratifications from Arkansas and Tennessee, prompted questions about how many seceded states had constitutionally binding legislatures.
